Terms of Service

These Terms govern your use of voltaicplananddesign.com and any lighting, control or electrical design services you purchase from Voltaic Verified (“Voltaic,” “we,” “us”). By submitting a quote request, paying for a package or using the site, you agree to these Terms.

1. The services

Voltaic prepares design documents — reflected ceiling plans, fixture and driver schedules, keypad and control schematics, load schedules and layered lighting plans — based on the floor plans and information you provide. The scope of each engagement is the package you select plus anything confirmed in writing in your quote.

2. Not engineering or installation

Voltaic is a design consultancy. Unless a licensed professional's stamp is expressly stated in your written quote, our documents are not sealed engineering drawings and we do not perform, supervise or inspect electrical installation. A licensed electrical contractor, and where required a licensed engineer, must review the documents, confirm compliance with the National Electrical Code and local amendments, pull permits, and perform all work. The authority having jurisdiction has final say on code compliance. See our Professional Disclaimer.

3. Your responsibilities

  • Provide accurate, current floor plans, dimensions, ceiling heights, structural and HVAC constraints, and product preferences.
  • Confirm you have the right to share the plans you upload.
  • Review deliverables promptly and have them verified by your licensed contractor before ordering fixtures or starting work.

Errors caused by inaccurate or incomplete information you supply are not our responsibility, and corrections may be billed as additional work.

4. Fees, payment and refunds

  • Package fees are flat and due in full before work begins unless your quote states otherwise.
  • The Builder Retainer renews monthly until cancelled. Cancel any time; cancellation takes effect at the end of the current paid month.
  • Invoices unpaid 10 days after the due date accrue a late charge of 1.5% per month (or the maximum allowed by law), and we may pause work and withhold deliverables until paid.
  • Refunds: a full refund is available if you cancel before we begin design work. Once work begins, fees are non-refundable, except that if we fail to deliver the agreed scope we will refund the unperformed portion.
  • Sales tax, where applicable, is calculated at checkout. Fees exclude fixtures, equipment, installation, permits and printing.

5. Turnaround and revisions

Turnaround estimates begin once we receive payment and complete plans. Each package includes one round of reasonable revisions within 30 days of delivery. Changes to the architecture, added rooms or new scope after delivery are billed separately at a quoted rate.

6. Intellectual property

Voltaic retains all rights in its design methods, templates, symbols, details, CAD blocks, software, branding and pre-existing materials. Upon full payment you receive a non-exclusive, perpetual license to use the deliverables for the single project identified in your quote, including sharing them with your contractor, engineer and permit office. Retainer clients may receive white-labeled deliverables for their named projects. You may not resell the deliverables, reuse them on other projects, or use them to train software without our written consent. Your floor plans remain yours; you grant us a license to use them solely to perform the services.

7. Portfolio use

We may show anonymized images of completed designs in our portfolio. We will never publish your name, address or identifiable plans without your permission. Opt out anytime by emailing us.

8. Warranty disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND VOLTAIC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW. Design documents describe intended results; actual light levels depend on fixtures, finishes and installation. Manufacturer products carry only the manufacturer's warranty.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VOLTAIC'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR SERVICES IS LIMITED TO THE FEES YOU PAID FOR THE SPECIFIC PROJECT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. VOLTAIC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, CONSTRUCTION DELAYS, REWORK, OR PROPERTY DAMAGE ARISING FROM INSTALLATION BY OTHERS. These limits do not apply to liability that cannot be limited by law, including gross negligence or willful misconduct.

10. Indemnification

You agree to defend, indemnify and hold harmless Voltaic and its owner, employees and contractors from third-party claims, losses and expenses (including reasonable attorneys' fees) arising from your plans or information, your use or modification of the deliverables, installation or construction by you or others, or your breach of these Terms.

11. Dispute resolution

Before filing any claim, you agree to contact us and try to resolve the dispute informally for 60 days. Any unresolved dispute will be settled by binding individual arbitration administered by the American Arbitration Association, seated in Greene or Montgomery County, Ohio. YOU AND VOLTAIC WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. Either party may bring an individual claim in small-claims court. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

12. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any matter not subject to arbitration will be heard exclusively in the state or federal courts located in Greene or Montgomery County, Ohio.

13. Force majeure and termination

We are not responsible for delays caused by events beyond our reasonable control, including natural disasters, utility or internet outages, illness, supplier or manufacturer changes, or government action. We may decline or end an engagement for non-payment, abusive conduct, or a request we believe is unsafe or unlawful, refunding any unearned fees.

14. General

These Terms, together with your written quote, are the entire agreement between us. If a provision is unenforceable, it is limited to the minimum extent necessary and the rest remains in effect. We may update these Terms; changes apply to new engagements after the posted date.
